Woman Killed By Police Officer Shooting At Dog In Arlington, Texas

A woman in the US has died of a gunshot wound after a police officer fired his gun when he saw a barking dog running towards him.
The unnamed policeman was responding to a call about the woman in Arlington, Texas.
She has been named as 30-year-old Margarita Brooks.
She died of her injury in hospital.
Police have described it as a tragedy, and say an investigation is under way.
Video at the link. So let me assist the police department with the description. Rather than a tragedy, this is classified as a homicide.

I note again for the record. Any time you call the police and they get involved, the level of danger for you goes up one or two orders of magnitude.

People who knew couple and the dog are saying it was a medium size beagle/retriever mix and always friendly.

A homicide requires only a volitional act by another person that results in death, and thus a homicide may result from accidental, reckless, or negligent acts even if there is no intent to cause harm.
“According to the Texas District & County Attorneys Association (TDCAA), “Someone is criminally negligent as to the result of his conduct if he ought to be aware of a substantial and unjustifiable risk that result would occur.”
The TDCAA continues, “This risk must be of such a nature that the failure to perceive it constitutes a gross deviation from the standard of care than an ordinary person would have exercised.”
I would consider mailmen, UPS drivers and pizza delivery to be “ordinary” people who regularly face dogs without spraying several rounds int he general direction.
At the very least this cop violated Col. Cooper’s 4th rule. With innocents down range he should not have fired his weapon.
