Very Detailed Analysis Of The Preliminaries Of The Kyle Rittenhouse Case

Found at Legal Insurrection.
This is a long read. But if you’re interested in following the goings-on in his case, this is the longest, most detailed and best analysis I’ve found.
The case hasn’t started yet, but in effect, it has because these decisions will make or break the prosecution’s assault on Kyle.
UPDATE: Dean Weingarten has another analysis.

I tend to agree with Mr. Andrew Branca on this: Absent massive jury intimidation or clear bias, there’s no reasonable way the jury hears and sees this mountain of evidence and testimony and finds that Kyle Rittenhouse is guilty.
That said, a jury trial is always a crap shoot. There’s very little on the planet less predictable than that 12-headed monster.
However, it is amusing reading about and watching the prosecution get slapped over and over by a judge (a former prosecutor who presumably knows all the tricks) who is clearly not putting up with any of his B.S.
Also, I wonder just how bad the State’s use-of-force expert must be for him to be withdrawn as a witness rather than subject him to cross-examination.

Looks like that prosecutor has a real loser of a case, his only hope is to pack the jury with ringers, and I doubt that either the defense or judge will allow this. The motions practice of this case is going so badly for the prosecutor – arguing with judges in motions hearings is a really bad idea, that sort of thing gets you invited into the judge’s chambers for a Come-To-Jesus talk… in some jurisdictions. If I were that prosecutor, I’d either dump the case, maybe plead it out to a provable misdemeanor, like curfew violation, or start looking for a new job. The one time I dealt with a prosecutor like that in a case like that, she was looking for a new job a month later – of course, she lost the case, big time.

@Hudson, the DA brought the case, because he he aspires to higher office and thought this was his ticket to seal his credentials with the left. Even if he loses the case, he will still be able to run on prosecuting a right wing extremist.
