While I’ve never had to use it, Kyle explains that his AR was out of battery before he tapped the forward assist. It probably saved his life. I don’t know why it didn’t go into battery – bad tolerances, failure to lube the gun, bad ammo, or what.
Here’s another part of the interview where it’s simply astonishing the level of unscrupulous behavior the DA got away with.

Glad he had the presence of mind to be aware of the condition of his rifle after the twisting & turning while firing that had gone on. A variety of things could’ve momentarily retarded the bolt to cause the condition. He fought through it.

I suspect that it was not the first time his AR had not gone into battery. 99.9% of AR owners would not check to see if the firearm was in battery. And most, even if by chance they saw that it was out of battery, would immediately use the forward assist.

A well trained and practiced ear knows the sound of a properly charged AR followed by a quick glance at the bolt. @Don, this is a rudimentary procedure in AR handling. The bolt grooves on the right side are purposely notched for this very reason.
Certainly you jest with the 99.9% forward assist comment?

He’s already cycled that gun at least twice. Ridding the world of a 5’3″ Pedo. I’m thinking he was checking his ejection port because it’s happened to him before. So yea, out of spec gun.
