The State of New York is Still Fighting the Bruen Decision

Surprising no one, if you haven’t been following the NY case of Ivan Antonyuk v. NY, the state of NY still hasn’t accepted Bruen, and won’t until the SCOTUS slaps them down again. The federal district court ruled in favor of Antonyuk in a lengthy and well crafted decision that issued a stay on the recently enacted NY law, only to be blocked and held in abatement by the 2nd Circuit by a three-judge panel who said nothing about the merits of the decision. The 2nd circuit overrode the district court decision with only a few cursory sentences.
The Antonyuk case was appealed directly to the supreme court, with Sotomayor demanding that NY reply. They did with this brief. In it, the state of NY insults the SCOTUS and tells them they aren’t needed.
Friend of TCJ Stephen Stamboulieh, a terrific attorney, genuinely good man and defender of liberty, issued his reply, and it’s a wonderful thing to behold.

This may not be over so the conclusory sentiment may be wrong, but may Stephen be victorious over his enemies and throw down their ruin upon the mountainside.

Unless and until the criminals holding power in New York start suffering consequences at a personal and painful level they WILL NOT STOP what they are doing. They have no reason to stop. It’s taxpayer money they use so it costs them nothing to keep thumbing their nose at court rulings they don’t like. Not sure how the SCOTUS could actually force them to obey a ruling….as the JustUs Department sure as hell isn’t going to force a state to uphold the Second Amendment. Be interesting to see if the Court can think of a way to enforce their rulings….but I doubt they can.

It’s good that the states are starting to ignore the federal courts. Pray that New York succeeds in their evil, and mars the much greater evil in DC.
Take control of your state, so it can start to ignore federal courts for good instead of evil.

The State of New York will never, ever accept Bruen, even when (if?) the Supreme Court “slaps them down again.”
The government of New York is a truly evil and criminal enterprise, they simply DGAF about the Supreme Court, period. New York has nullified the Second Amendment for well over a century. New York has effectively seceded from the Union and refuses to be bound by the Constitution and Bill of Rights unless it suites their immediate agenda (which is abortion, anal sodomy, and graft).
If the Court reaffirms Bruen, the State will simply find another pretext for denying Second Amendment rights, and then daring anyone they arrest and convict on felony gun charges to spend another fourteen years suing them (which was the length of time between Heller and Bruen).
The only way Bruen will be respected by the State of New York is if the President sends the 101st Airborne in with bayonets fixed, the same way that Eisenhower did in Little Rock to enforce Brown v. Board of Education.
That’s not going to happen.
There is only one way to deal with the criminals in New York, and I can’t say what it is in print. Let’s just say that their motivation to ban and confiscate guns is the same as Stalin’s… it is a policy of very, very narrow self-interest and self-preservation.
