This may be exactly what the doctor ordered.
In recent years, Presidents have used EOs to ‘bypass Congress’. But an EO can only apply to employees of the Executive Branch. Here we have (the equivalent of) an EO that presumes to apply outside the confines of the Executive Branch. That is: it presumes to make law and thereby violates Article I § 1 of the Constitution. Any court would be (almost) forced to rule against the DOJ on the issue, thus putting the “stroke of a pen, law of the land… cool” usurpers on notice that they can’t do certain things at all.

Interfering with private sales of firearms would violate Due Process. The right to own private property includes by extension the right to dispose of that property as you see fit, to include engaging in commerce with it. Anything you lawfully can own, you also lawfully can sell or buy (to include NFA devices, provided the buyer has jumped through all the proper ATF hoops).
Even if they could get a law to that effect passed, it still would fail constitutional muster. But seeing as we have entered the post-Constitutional era, that might not count for much.

Is this plan blatantly unconstitutional and illegal? Of course. So what. There is NOBODY in a position on power who will do a damn thing about this. Virtually ALL the “rules” that BATFEces … and most FED agencies…enforce are illegal and unconstitutional. They don’t care. None of them. They mean to RULE us and will brook no opposition. There is NO longer any legal or peaceful options left for We The People to turn to. TINVOWOOT
I’ve heard Franks observation offered up before, I want to think he’s correct. Honestly I need to do the research.
Either way, I could care less what poopy pants signs in the White House . I’m done with their nonsense.
The single most important thing we all can do is simply refuse to comply. Not saying get yourself jammed up with DOJ, just trade buy or sell just like we did last week.

Executive Orders were intended previously to be applicable only to the federal executive branch. However that was in the “before times.” We have had a totalitarian coup and now the government has no guardrails.
