   In recent years, Presidents have used EOs to ‘bypass Congress’. But an EO can only apply to employees of the Executive Branch. Here we have (the equivalent of) an EO that presumes to apply outside the confines of the Executive Branch. That is: it presumes to make law and thereby violates Article I § 1 of the Constitution. Any court would be (almost) forced to rule against the DOJ on the issue, thus putting the “stroke of a pen, law of the land… cool” usurpers on notice that they can’t do certain things at all.

   Even if they could get a law to that effect passed, it still would fail constitutional muster. But seeing as we have entered the post-Constitutional era, that might not count for much.

   The single most important thing we all can do is simply refuse to comply. Not saying get yourself jammed up with DOJ, just trade buy or sell just like we did last week.

   Executive Orders were intended previously to be applicable only to the federal executive branch. However that was in the “before times.” We have had a totalitarian coup and now the government has no guardrails.
