And here is Mark Smith to explain. But you know, it seems that the conservatives on the court are the only ones that have manners and refuse to consider cases that haven’t been fully decided in the lower courts.
As if that’s a requirement or something. Sotomayor apparently has no problem bossing the lower courts around on her own.
I still think it all comes down to rank cowardice.

IMO, it comes more from lawyers wanting to provide the opportunity for other lawyers (who haven’t yet secured a cushy seat on the .gov gravy train) to post billable hours to their clients.

I just don’t believe they really want us commoners to own firearms but must slow walk restrictions less we rise up. At best, they have lost their purpose- to stop infringements of the Constitution in favor of “our legal policies and procedures”. Hang their P&Ps, if they see a lower court misbehave stop it immediately ( That “I know it when I see it” thing), then let the lower court respond. They should also have the power to remove judges that won’t follow their oath. Faced with losing their cushy job and life time of benefits AND retirement money I suspect most would behave in the first place.
