No government in the United States — be it federal, state, or local — is allowed to discriminate against an individual on the basis of age, gender (or gender expression), sex, race, ethnicity, religion or creed, or national origin.
So if Jose from Mexico gets arrested and booked for auto theft in a “sanctuary city” and is released because he’s here illegally (and releasing him is the only way to keep ICE off of him), but Joe from America is arrested and booked for the same crime and is held for formal charges…
… how is that not differential treatment based on national origin?
I think if Joe got a good lawyer, they could make a valid case for discrimination.
