Churches challenge New York’s bar on guns in sensitive locations
BY PGF2 years, 1 month ago
If they weren’t Corporations under the Internal Revenue Code, they wouldn’t have this problem!
More than two dozen churches and a socially conservative organization this week filed a federal lawsuit challenging New York’s restrictions on guns in sensitive areas.
The lawsuit is the latest effort to challenge New York’s law approved in the wake of a Supreme Court decision that found a century-old concealed carry law was unconstitutional. State lawmakers and Gov. Kathy Hochul agreed to a measure that limited where guns can be carried as well as created new requirements for a concealed carry license.
The churches and the group, New Yorkers for Constitutional Freedoms, pointed to the rise in threats against houses of worship, arguing that such a ban violates their Second Amendment rights as well as a natural right to self-defense while attending a religious service.
“The disarming of citizens while attending places of ‘worship or religious observance’ is not taking place in a vacuum,” the lawsuit states. “Religiously motivated or targeted attacks continue to be a risk to every congregation nationally and in the State of New York.”
The gun law approved in July limits where guns can be carried. Locations like mass transit, parks, as well as houses of worship are considered “sensitive locations” under the law known as the Conceal Carry Improvement Act. Heavily trafficked locations like Times Square also bar concealed carry firearms.

I appreciate your website.
I do have two questions about your introductory comment. I was asked to read the burdensome New York shortly after it was enacted. As the source article mentions, it refers to “Houses of Worship” but does not differentiate between incorporated bodies and unincorporated associations. Can you tell me where the NY law treats an incorporated body differently than an unincorporated association?
Also, to my knowledge the IRS does not incorporate or establish corporations. That is done at the state level, usually by the state Secretary of State, but sometimes by a Department of Corporations. Can you tell me what you mean with your reference to Corporations under the Internal Revenue Code?
Thanks, and keep up the good work.

Kiss that one good-bye. Text, history, and tradition say that we are REQUIRED to bring our ‘peeces’ to church :-)

501(C)(3) does not require incorporation, and IRS regs use the term “organization”.

I was pretty sure that most Christian patriots were aware of the nationalization of the American Church under the Johnson Amendment, but obviously we’ll need a post on this topic.

PGF,
Yes. Please offer a brief post, as I am not aware of what you are alluding to re: “American Church”; I am aware of 501(c)(3) rules, and the “Johnson Amendment” prohibiting “political speech” (sadly complied with as recently with the scamdemic).
And, I find your introductory sentence an interesting, though perhaps impractical, observation. Churches (religious groups) are typically incorporated for legal reasons other than taxes, though tax advantages are clearly a “wrongful(telling)” motivation for many independent “churches”(tax scams). Then again I might not fully understand your comment.
Related, yesterday the judge in the Amended Antonyuk case in NDNY issued a temporary restraining order wherein among other findings he found that in fact “places of worship” could be identified as “sensitive places” (aka “gun free zones”) excepting “for those persons who have been tasked with the duty to keep the peace at the place of worship or religious observation.” (pg 35; 1:22-cv-00986)
This is blatantly in error as the “analogues” offered were from after 1868; hopefully will be corrected during oral arguments, or eventually through appeals.

“American Church” is slang I use as an insult. As you know, there is no such thing. We could say “American Pharisees” or similar. It’s along those lines.

PGF,
Along the line of – there is no definition of “religion” in US statute, case law or regulations, as to offer one would be to define “government” as it has evolved ? …
And, that would violate the “no law respecting an establishment of religion” ideal (?). …
If only we, the true, faithful, law-abiding citizens the United States of America could stand and admit that a belief in G-d (monotheistic, Judeo-Christian) is a prerequisite to an understanding of the “republic” envisioned. And the “establishment clause” was meant to preclude the rise of a “theocracy”…
We need to exit the “Five ‘Is'” (until the “monarchy” and “royals” are history), send all the “anglophiles” back to the UK, all foreign diplomats need to be bonded (100k ozs of gold each), “decertify all unions”, institute “conscription” for both the military and 90% of the federal workforce (no lifetime benefits), eliminate every federal department/agency which functionally duplicates what 15 or more states do, … of course, repeal the 13th through 17th Amendments, …
And, bring back and follow through on the death penalty, including for failure to faithfully act upon one’s oath to the Constitution, … assuming we also reinstate the precept of “innocent until proven guilty” and government must prove “mens rea”.
Finally, for every new federal provision of law enacted to be effective it must have a “sunset” of 5, 7, 10 or 15 years, and be accompanied by voiding/
reversal of no less than 10 other federal laws and 1000 regulations.
[I’d be an historic “benevolent dictator”.]
Thanks for clarifying.

Maybe it should be Hebraic/Christian precepts (?).
But, language being what it is, over some period during the last two millennia Isrealites and Hebrews in Europe became known as “Jewish”. Even though, the term Jewish became (inappropriately) synonymous with “Hebrew”, today the term “Jewish” is not indicative of a “religion”. … Here is just one possible beginning to your research: https://www.etymonline.com/word/Jew …
Then, I acknowledge that perhaps you speak Aramaic, Hebrew and other relevant ancient languages (I don’t), and thus have insights given those languages and the fallibility of translators over the last two millennia that are beyond my comprehension.
Regardless, I would encourage you to accept it is how you present your faith that matters most. Jesus said: “Follow me.” I understand He was speaking of the manner in which He interacted and taught others; He led by example. … Do you agree ?
Where in the New Testament does Jesus scold as you did in your writing ?
Separately, the New Testament makes clear that Jesus the Christ (Yahshua or Yeshua) was of the House of David. … Do you agree ?
Can you direct me to where in scripture Jesus denies that the Hebrews and Israelites are His Father’s chosen people ?
Where does Jesus deny that the Old Testament is His Father’s Word or that it should not be followed ? … Did not Jesus keep sacred and observe all holy days and periods set forth in the Old Testament ?
Last I offer, you can believe what you will – whether you attempt to confirm what others teach you, is wholly up to you.
P.S. For fun invest some time researching the background of the individuals who signed the Declaration of Independence and Constitution; I would be interested to know how you “profile” them – age, occupation, education, religion/agnostic/atheist, … (let’s skip over ‘gender”; I expect the answer is clear and you are not a modern day, “woke”, revisionist) … (other characteristics of your choosing) …
P.P.S. Sometimes the “keyboard” is mightier than the “sword”.
