Charges Dropped Against First Kenosha Shooter Who Fired Into Air

On October 13, 2020, the Gateway Pundit broke the story that the person who fired the first shot the night Kyle Rittenhouse was forced to defend his life, Joshua Ziminski, was arrested and charged.

The man who fired the first shots from behind Kyle Rittenhouse during the fatal incident in Kenosha has been charged.

Joshua Ziminski, 35, has been charged with disorderly conduct and use of a dangerous weapon for firing his weapon during the incident on August 25.

On the face of it, that would appear to bolster Rittenhouse’s self-defense claim. He was being attacked at the time by Joseph Rosenbaum and someone fired a gun. Sane people would accepted that he had reasonable cause to fear for his life. Apparently the prosecutors think so as well.

The only charge that remains is disorderly conduct; the felony recklessly endangering safety charge for firing the handgun will not proceed. Having to argue in one case that Ziminski fired the first shot that night might have proved embarrassing while trying to prosecute the Rittenhouse case, where their story is that Kyle started all the trouble. So Ziminski’s inconvenient gun charge has simply gone away.

Also an oddity in the Ziminski situation: the lack of any charges for possession of a firearm. Per a Wisconsin Right Now report, Ziminski has multiple convictions for violating harassment orders, which may make him a prohibited person for domestic violence. He also has a 2005 marijuana conviction which definitely gave him prohibited status.

The Ziminski charging document, as seen above, makes it clear that not only do the police have video evidence of Ziminski in possession of a firearm, but Ziminski and his wife both admitted that he had a gun. Other people have been convicted of unlawful possession on weaker evidence, but the Wisconsin prosecutors cannot admit that a bad guy had and used a gun that night before Rittenhouse did.

It appears that the prosecutors prefer to let a violent criminal off rather than lose the chance to persecute Kyle Rittenhouse.

The people who made this decision are called “Officers of the court.”  They swore oaths, promised to serve justice, and will one day be judged by God for their actions.

But for now, they’d rather stick it to the only one there that night who did the right thing.  Because darkness is light and light is darkness.

Charges Against The First Shooter In Kenosha Have Been Dropped

Dean Weingarten On Wisconsin Open Carry And What That Has To Do With Kyle Rittenhouse

Wisconsin Statute 948.60 regulates the possession of a dangerous weapon by persons under 18 years old. In paragraph (2) (a) it states:

(a) Any person under 18 years of age who possesses or goes armed with a dangerous weapon is guilty of a Class A misdemeanor.

Paragraph (3) lists exceptions. (3)(c) excludes most people who are under 18, except those in violation of 941.28 or 29.304 and 29.539.

(c) This section applies only to a person under 18 years of age who possesses or is armed with a rifle or a shotgun if the person is in violation of s. 941.28 or is not in compliance with ss. 29.304 and 29.593. This section applies only to an adult who transfers a firearm to a person under 18 years of age if the person under 18 years of age is not in compliance with ss. 29.304 and 29.593 or to an adult who is in violation of s. 941.28.

Statute 948.60 only applies to a person under the age of 18 who are in violation of 941.28 or not in compliance with 29.304 and 29.593.

What does it take to be in violation of 941.28? Here is the statute:

(2) No person may sell or offer to sell, transport, purchase, possess or go armed with a short-barreled shotgun or short-barreled rifle.

In the statute, short-barreled shotguns or short-barreled rifles are those which require a special license under the National Firearms Act. In general, those are rifles with a barrel less than 16 inches in length or shotguns with a barrel less than 18 inches in length, or either which have an overall length of less than 26 inches.

The rifle carried by Kyle Rittenhouse, as an ordinary AR15 type and does not fall into those categories, so Kyle was not violating 941.28.

Was Kyle in violation of Wisconsin statute 29.304 and statute 29.539? These statutes deal with hunting regulation and with people under the age of 16 carrying rifles and shotguns. First, statute 29.304:

29.304  Restrictions on hunting and use of firearms by persons under 16 years of age.

(b) Restrictions on possession or control of a firearm. No person 14 years of age or older but under 16 years of age may have in his or her possession or control any firearm unless he or she:

Kyle is reported to be over 16 years old, so he was not violating statute 29.304.

How about statute 29.539?

29.593  Requirement for certificate of accomplishment to obtain hunting approval.

Kyle was not hunting, so statute 29.539 does not apply.

To sum up: Wisconsin statutes 940.60 only forbid people under the age of 18 from possessing or carrying dangerous weapons in very limited cases. If a person is 16 years of age or older, the statute only applies to rifles and shotguns which are covered under the National Firearms Act as short-barreled rifles or shotguns. People who are hunting have to comply with the hunting regulations, and there are general restrictions for people under the age of 16.

If only folks at Politifact and the rest of the MSM were that good at research and analysis.  They can only dream and wish.

Kyle Rittenhouse Speaks

First of all, Dean Weingarten wants to know why the real perpetrators of crimes are not in prison.

As there were multiple, coordinated attacks, they could be charged with conspiracy to commit a felony, under Wisconsin statutes 939.31.

The first, unknown attacker, clearly committed battery against Kyle Rittenhouse with the flying kick attack; because it was countered, the damage may not have been great, making it a Class A misdemeanor under Wisconsin statutes 940.19.

Huber committed a battery, but Huber is dead, so he will not be charged. Because he died, however, in the commission of a crime, the other two combatants may be charged with felony murder, Wisconsin statute 940.30. All three attackers were acting in concert, so the felony murder statute is likely to apply.

Grosskreutz could be charged under the endangering safety by use of a deadly weapon, statute, 941.20, for his actions with the semi-automatic pistol. 941.20 has an exception for defense of privilege of self-defense, or defense of others, which Grosskreutz might claim, and which Rittenhouse is already claiming in his lawyers’ statement.

The Kenosha County Prosecutor has decided to press charges against Kyle Rittenhouse, and not against his attackers. This shows a reluctance, almost certainly due to political pressure, not to charge the rioters. All three attackers appear to be from Wisconsin, so there is no interstate nexus for federal charges, unless it can be shown that they received funding or direction from out of state, which would be difficult to prove.

The case shows the incredible power of prosecutors to decide who will be charged, and who will not. The voters have the ultimate authority to place or remove prosecutors. Prosecutors are almost never removed unless their crimes are blatant.

But you know who is in prison?  Not the sexual predator, not the wife-beater (they are both in hell now), and not the felon who is guilty of burglary and assault with a deadly weapon, but Kyle Rittenhouse.

He is a fine man and seems to be holding up, but he deserves to be at home given that he is innocent of all charges.

As for what the future holds, I suspect this won’t be over for a very long time.  Even when it’s over, it won’t really be over (remembrances of Mike Vanderboegh).

Finally, I’ve had a difficult time pushing the piece on the Comprehensive Time-Spliced Video of Kenosha and getting traffic to it.  First of all, I can say that I’m not responsible for much of the content, so the intent isn’t to make me look good.

Second, it angers me when I see the trash from the MSM on the Kenosha event, and this video is like artillery fire on the MSM trash.

But I can barely keep up with the breathtaking speed and dizzying accuracy of the analyses at both AR-15.com and Reddit/Firearms.

AR-15.com has comprehensive analyses at both this link and this one (the first being first in the sequence, the second being updated but different).

Reddit/Firearms also had a good analysis up, which has been taken down by the awful moderators, but which I lifted here (for the most part, although the loss of comments is regrettable).

The best video I’ve seen to date is a time-spliced video built and posted by a Redditor and dropped out as an MP4 file.  Here is the link (if the link gets taken down, I downloaded the full video and will repost).  Allow me to explain why I’m lifting some of the prose and explanation.  This is “fair use,” as I do not make a penny off of this web site.

Second, I’ve seen far too many valuable, creative, informative discussion threads removed by awful moderators to trust that it will be there in the future.  They could send me a certified letter signed by an attorney declaring that it will never be removed, and I’d still not trust them.  With that said, I will be lifting only parts of the explanation by the author, and I encourage you to go to the balance of the explanation and the comments (which are equally informative).

The entire thing is a single synced shot, with the exception of the part after the shooting where the entire clip from Regg’s stream of the shooting is played again, and a few seconds at the beginning showing CJ’s shot of Kyle leaving the gas station. Other than that, everything can be considered sequential, synced within about .05 seconds.

The first clip is mostly in there for irony’s sake, and to show that he was wearing his shirt properly earlier, but it’s part of a larger confrontation which started when rioters got angry at the gas station defenders for putting out a dumpster fire.

That may have been what prompted him to start chasing Kyle (long time after this incident happened) when he spotted him 50ft outside the gas station parking lot, or Kyle may have started running on his own, drawing people to chase him. Either way, he appears to start running with the extinguisher about a second before “burn inside” is yelled”, dropping it a few seconds later.

That’s all I’ll lift.  There’s a lot more at the link, and as I said, I encourage you to visit the link and watch the entire video (linked above), multiple times if you have to.  I have.

It’s obvious to me that Mr. Rittenhouse attempted to put out a fire caused by Rosenbaum, Rosenbaum didn’t like it (because he was trying to expand the fire to nearby buildings and police vehicles), and went after Rittenhouse.

Kyle Rittenhouse defended his life, and then others gave chase.  Kyle was on the ground when the rest of the shooting occurred, in one instance defending his life against an attack with a skateboard (which could be lethal in an attack to the head or spine), and in another instance against a convicted felon with a pistol who was advancing towards him (and who unapologetic and later claimed that his only regret is in not emptying his magazine into Kyle).

If you still don’t understand how this went down, I encourage you to go view the video again.  In the exchange, he killed a convicted sex offender (and also convicted arsonist), a wife beater, and wounded (and took out of the fight) another felon.

There’s another aspect that hasn’t been discussed at all, and that is the police interactions with the militia before this event went down.  Watch one of those present explain it to you.

Let’s be clear.  The founders were deeply opposed to a standing army, and the police have become that standing army in many instances, especially with militarized tactics like SWAT teams and no-knock raids.

I’m not opposed to the use of militia to aid “peace officers.”  That’s how the founders intended it to work.  I’m also not opposed to what the Kenosha police told the militia, nor their intended use of the militia (assuming this report is true).

What I am opposed to is the arrest of Kyle Rittenhouse in this instance given that he was doing what was expected of him (and also acted only in self defense), and the office of the DA filing charges of murder against Rittenhouse.  The DA (Michael Graveley) will now use his office to conduct lawfare against the very people with whom the police made a bargain that very day.

But you can be sure of one thing.  Graveley’s office will make sure that the U.S. Department of Justice investigates the shooting of Jacob Blake.
